THE CHEMICAL industry signifyed disappointment last week over the greatest possible Court's 5-4 ruling that railroad workers who have an illness linked to occupational position to asbestos can recover damages for fear of eventually developing asbestos-related cancer.
"We have that a railroad worker suffering from asbestosis can win back for the heightened anxiety he experiences because of his vulnerability to a more dread disease," Justice mercy Bader Ginsburg wrote for the majority in interpreting the Federal Employer's Liability Act.
